What is Independent Dispute Resolution (IDR)?
Independent Dispute Resolution is the federal arbitration process under the No Surprises Act that decides the payment for an out-of-network claim when a provider and a health plan cannot agree.
After the plan’s initial payment or denial, the parties have a 30-business-day open negotiation period. If they do not agree, either party can start IDR within 4 business days after negotiation ends. Each side submits an offer, and a certified IDR entity chooses one of the two.
